These Terms govern your use of our website, which is owned and controlled by Reading For Education, LLC and its affiliates and subsidiaries ("Reading for Education", "RFE," "us", "our", or "we"), and any related purchases or orders you submit through the website. By using our website or submitting any purchase or order through our website, you are agreeing to these Terms. Please read them carefully.

2. Using our Website

You must follow any policies made available to you within the website.
Don't misuse our website. For example, don't interfere with our website or try to access it using a method other than the interface and the instructions that we provide. You may use our website only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing you access to our website if you do not comply with our terms or policies or if we are investigating suspected misconduct.
Using our website does not give you ownership of any intellectual property rights in our website or the content you access. Additionally, you agree not to:

  • Use the website in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the website, including their ability to engage in real time activities through the website.
  • Use any robot, spider or other automatic device, process or means to access the website for any purpose, including monitoring or copying any of the material on the website.
  • Use any manual process to monitor or copy any of the material on the website or for any other unauthorized purpose without our prior written consent.

Reading for Education may, but is not obligated to, monitor or review any areas on the website where you transmit or provide information, including but not limited to areas where our products and services are available.

To the maximum extent permitted by law, Reading for Education will have no liability related to your information arising under the laws of copyright, libel, privacy, obscenity, or otherwise, or losses incurred due to your failure to maintain the confidentiality of your account credentials. Reading for Education also disclaims all liability with respect to the misuse, loss, modification, or unavailability of any of your information.

Without limiting the foregoing, our trademarks or trade dresses may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion among users, or in any manner that disparages or discredits us.

7. Proprietary Rights

Your use of the website confirms your acknowledgment that the website contains certain content (such as text, graphics, photographs, video, audio, code, and other data or information relating to any subject) ("Content"), that is protected by copyrights, trademarks, trade secrets, or other proprietary rights, and that these rights are valid and protected in all forms, media and technologies existing now or hereinafter developed. All Content is or may be copyrighted as a collective work under the U.S. copyright laws, and Reading for Education owns a copyright in the selection, coordination, arrangement, and enhancement of such Content on the website. Terms Applicable to Purchases and Orders

A. Your Orders.

By placing an order with RFE, you are (1) offering to purchase a product and/or service, (2) representing that you are at least 18 years old, (3) representing that all information you provide to us in connection with such order is true and accurate, and (4) representing that you are an authorized user of the payment method provided. When you send us your order, we may verify certain items before the order is fulfilled, including, without limitation, your personal information, your payment information, and your creditworthiness.
RFE reserves the right to: (1) refuse any order you place with us; (2) correct any errors, inaccuracies or omissions (including but not limited to the price) with regard to the products or services offered; (4) change or update information in connection with any products or services offered; and/or (5) modify or cancel your order, whether or not the order has been confirmed, each at any time without notice to you (including after you have submitted your order) and without liability to you. If we modify your order, we will attempt to give you prior notice of this and provide you with the opportunity to cancel the order in its entirety. If we cancel your order, we will attempt to notify you by contacting you via the contact information you provided at the time the order was made. We reserve the right to limit, reject, modify, or cancel orders that, in our sole judgment, appear to be placed by unauthorized parties, including resellers.
If your payment method has already been charged for an order that is later modified or cancelled, RFE shall issue you a refund in the amount of the incorrect price back to your original method of payment. We apologize for any inconvenience this may cause you.
RFE accepts the following methods of payment on our Website: Visa, MasterCard, American Express, Discover, and PayPal.

B. Product Description and Pricing

All prices and products advertised are subject to change. Although the website is composed with care, it may happen that the pricing information on the website contains errors. We are not bound by our offer or any prices on the website and we therefore reserve the right to modify or cancel your purchase in the event of spelling, pricing, or other errors on the website.
All prices displayed on the website are quoted in US Dollars ($).
Shipping costs may be applied per order and depend on where your order is shipped and by what method. Shipping costs and all other applicable taxes, fees or charges of any nature shall be added to the total amount of your purchase and will be displayed prior to checkout.
The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colors accurately, we cannot guarantee that your computer's display of the colors accurately reflect the actual colors of the product(s). Your product(s) and the packaging of your product(s) may vary from that shown on images on our website.
Reading for Education reserves the right to assess an Order Processing Fee on any order submitted through its website, platform or other sales channels. The order Processing Fee is intended to cover administrative, operational, payment processing, verification, handling, and related cost associated with the acceptance, review and fulfillment of an order.

C. Shipping, Delivery, Returns, and Exchanges

If you are unhappy with the product for any reason, you may contact us to make an exchange for the item. Please note that if you purchased online and the fundraiser you supported has not yet been paid out, then you can receive a full refund, but the refund may be deducted from the online sales of that fundraiser as well as the eventual payout to the fundraiser.
RFE does not ship internationally.

D. Third Party Products Sold on Website or Third-Party Merchants

RFE is not responsible for any third-party products or for the actions or inactions of any third- party vendors or suppliers. RFE's inclusion of such products does not imply any endorsement of such or, unless expressly disclosed otherwise, any sponsorship, affiliation, or association with such vendor(s) or supplier(s). RFE does not assume any responsibility or liability for the products of third parties. While RFE aims to ensure that all third-party vendors and suppliers are honest and truthful when making representations regarding their products and/or the causes they claim to support and how, we cannot warrant or represent that the statements they make are truthful, complete or accurate. Please carefully review the terms of use, privacy policies, and all other relevant user agreements for the third-party products.

E. Third-Party Rebates

The website may operate an interactive transaction service allowing access to third party merchant sites ("Merchants") from which you may purchase certain goods or services. RFE makes rebates to a K-12 school designated by you based on referral fees generated by your purchases. The amount of the rebate will be in accordance with the website's policy in effect at the time a purchase is made. You must designate the K-12 school prior to following the link to the Merchant's site to ensure proper credit of a rebate. You are not authorized to make any representations or warranties to a K-12 school regarding the rebate or RFE's service. The rebates are made by RFE and are not tax-deductible by you or RFE.

F. Referral Fees

To generate a referral fee, you must follow the link on the website to the Merchant site, make a purchase, accept delivery, and make payment to the Merchant. The amount of referral fees payable to RFE, and therefore the amount of the rebate to the K-12 school, varies depending on the Merchant and may vary depending on the item purchased. Referral fees are subject to adjustment in the event of returns by you and according to other terms and conditions between RFE and the Merchant. From time to time, RFE may publish the referral fee schedule established with participating Merchants. RFE will make every reasonable effort to ensure that referral fees actually due are paid, but cannot warrant that the referral fees listed will be paid in every case.

G. Gift Cards

Caring For Classrooms Gift Cards. Redemption of Caring For Classrooms Gift Cards may only be made at www.caringforclassrooms.org. No fees are charged for the use of the gift cards beyond shipping and appropriate taxes. The gift cards have no expiration date. The gift cards are not refundable for cash except where required by law. Unused balances will remain on the card. Gift cards remain the property of the school where issued and are not transferable. Gift cards should only be used to purchase items for the classroom.
Gift of Reading Gift Cards. Redemption of Gift of Reading Gift Cards may only be made at www.giftofreading.net. No fees are charged for the use of the gift cards beyond shipping and appropriate taxes. The gift cards have no expiration date. The gift cards are not refundable for cash except where required by law. Unused balances will remain on the card.

H. iChoice Gift Card Program

The iChoice Gift Card is a fundraising product offered in support of participating schools and educational organizations. Supporters may purchase an iChoice Gift Card and subsequently redeem the card for one or more gift cards issued by participating third-party retail merchants, subject to availability and the terms and conditions of the respective merchant.
The iChoice Gift Card itself is not redeemable for cash, except where required by applicable law, and may only be redeemed through the authorized iChoice redemption platform for eligible participating merchant gift cards. Upon redemption, the supporter will receive gift card value equal to the available balance redeemed, subject to any applicable program terms, limitations, or restrictions.
Participating retail merchants may provide discounts, rebates, commissions, marketing allowances, or other compensation in connection with the purchase or redemption of merchant gift cards through the iChoice program. Any such amounts received by the program operator shall be retained and designated as fundraising proceeds for the benefit of the participating school or educational organization selected in connection with the purchase of the iChoice Gift Card. The purchaser and recipient acknowledge and agree that such discounts, commissions, rebates, or other compensation are not credited to, payable to, or redeemable by the purchaser, cardholder, or gift recipient, and instead constitute a charitable or fundraising benefit for the participating school or organization.
The amount of fundraising proceeds generated may vary by merchant and may change from time to time without notice. No representation or guarantee is made regarding the amount of fundraising revenue that will be earned by any participating school or organization from any particular purchase or redemption transaction.
All merchant gift cards obtained through redemption of an iChoice Gift Card are subject to the terms, conditions, policies, and restrictions established by the issuing merchant. The program operator is not responsible for the products, services, gift card terms, availability, or actions of any participating merchant.
The program operator reserves the right to modify, suspend, or terminate the iChoice Gift Card program, participating merchants, redemption options, or fundraising arrangements at any time, subject to applicable law.
Commissions & Discounts. Any discounts or commissions from Merchants or other gift cards that RFE receives will all be transferred to the applicable schools as part of the fundraising program.

We are constantly changing and improving our website. We may add or remove functionalities or features, and we may suspend or stop a service altogether.
You can stop using our website at any time. We may also stop providing services to you, or add or create new limits to our website at any time.

If our website contains links to other sites and resources provided by third parties, these links are provided for your convenience only and are not intended and should not be construed as any endorsement or approval of, association with or control over any such organization or site or the contents thereof. THE FOREGOING LIMITATIONS WILL APPLY WHETHER SUCH DAMAGES ARISE OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE AND REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY SO SOME OR ALL OF THE ABOVE LIMITATIONS OF LIABILITY MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify, defend, and hold harmless Reading for Education, and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including attorneys' fees, arising from or relating to your use or misuse of the website or any of our products or services or violation of these Terms.

14. Governing Law

All matters relating to the website, these Terms, our products or services, and/or our website privacy policy, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Tennessee without giving effect to any choice or conflict of law provision or rule.

Dispute Resolution (Including Arbitration; Class Action Waiver; Jury Trial Waiver)

A. Binding Arbitration

Any controversy or claim between you and RFE or our subsidiaries and affiliates, and our or their officers, directors, and employees arising out of or relating to these Terms, your use of the website, or the products or services you purchased or ordered, shall be settled exclusively by binding arbitration, conducted by a single arbitrator in the city of Nashville, Tennessee, in accordance with, but not administered by, the American Arbitration Association's ("AAA") Consumer Arbitration Rules ("Rules"), with the exception that, notwithstanding anything to the contrary in the AAA Rules, each party to the arbitration shall equally bear their own respective costs and expenses in participating in the arbitration and shall equally share in the costs and fees contemplated by the AAA Rules, including, without limitation, all arbitrator expenses. In accordance with the AAA Rules, the party initiating the arbitration (either you or RFE) is responsible for paying the filing fee.
The arbitration award shall be in writing and shall include findings of fact and conclusions of law. Judgment on the arbitration award may be entered into any court having jurisdiction thereof. Either party may seek any interim or preliminary relief from a court of competent jurisdiction necessary to protect the rights or property of either party pending the completion of arbitration.

B. Class Action Waiver; Jury Trial Waiver

Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party, nor shall arbitration on a class action basis be permitted.

C. Limitation on Time to File Claims

ANY CAUSE OF ACTION YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS, OUR PRIVACY POLICY, THE WEBSITE, OR ANY PRODUCTS OR SERVICES PURCHASED OR ORDERED MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

16. Waiver and Severability

If you do not comply with these terms, and we do not take action right away, this does not mean that we are giving up any rights that we may have (such as taking action in the future). If it turns out that a particular term is not enforceable, this will not affect any other terms.

We may modify these Terms or any additional terms that apply to the website to, for example, reflect changes to the law or changes to our website or the services or products offered through our website. You should look at the terms regularly. We will post notice of modifications to these Terms on this page by updating the "Last Modified" date at the top of this webpage. Changes will not apply retroactively and will become effective as soon as this webpage's "Last Modified" date is posted.
